Wyclef supports Haiti bill without consideration of impacts on Haitian workers

Pushing for a renewal of trade benefits without a serious look at
the negative impacts these jobs provide is very short sighted.  If
Wyclef was serious about promoting jobs that are good for Haitians, he
would consider a more nuanced approach which would force those that set
up shop in Haiti to also respect freedom of association, safe working
conditions, and a wage that will support a family.  There are currently
factory workers that struggle on a daily basis, and simply renewing the
trade rules for Haiti will do little to help improve the quality of
living for Haitians.

Finally, if Wyclef was really serious about providing jobs, he would
take a look at the factories that produce his own clothing that is sold
at concerts, t-shirt shops, and record stores. Musicians don't often
want to put their money where their mouth is.  I challenge Wyclef to
use his power to demand that his clothing be produced in Haitian
factories under conditions that abide by national and international law.

WASHINGTON - The world of music, politics and fashion collided on
Capitol
Hill Wednesday as high-level Haitian government officials joined forces
with hip-hop musician Wyclef Jean to lobby members of Congress to pass
a bill enhancing apparel trade benefits for the island nation before
they adjourn for the year.

Jean, who was born in Haiti, said he donned his "Joe college" duds -
an oxford shirt under a pullover with striped tie, plaid pants and hip
leather sneakers - to make the case for expanding apparel trade with
Haiti. He was part of a delegation, comprising Haitian government
officials and several apparel manufacturers, who met with Reps. Charles
Rangel (D., N.Y.), the incoming chairman of the House Ways & Means
Committee next year, Clay Shaw (R., Fla.), Jerry Weller (R., Ill.) and
Sen. Mike DeWine (R., Ohio).

"For me, it's very important because what I'm trying to do in the
next 10 to 15 years is to get investors excited about Haiti again,"
said Jean, whose uncle, Raymond Joseph, is the ambassador to Haiti.
"Apparel is important because it provides jobs. I'm here lobbying for
this bill because if we can give 10,000 people jobs instantly, it sends
a signal to investors that says the doors are really open for Haiti."

Haiti, the poorest country in the Western Hemisphere, has been
losing apparel production to China and Central American and Caribbean
countries since the major trading partners around the world removed
quotas on apparel and textile products in 2005. As a result, apparel
employment in Haiti has fallen from a peak of 100,000 jobs to less than
20,000, a change that could threaten fledgling democratic reforms and
destabilize the region, Haitian officials warned. The delegation
pressed Congressional members to pass legislation introduced by Rep.
Bill Thomas (R., Calif.) that would enhance the duty free benefits for
Haiti through a 50 percent value-added rule that increases to a 60
percent requirement in the fifth year in a lame-duck session in
December. But the Thomas bill, which also contains an extension of
trade benefits for sub-Saharan African countries, has met
strong
opposition from textile-state lawmakers, who succeeded in blocking it
from an expedited vote in the House in September. The House members
argued in a letter to Republican leaders that the expanded benefits for
Haiti would allow companies to use Chinese fabric and yarns, which
would displace U.S. business in Haiti and "devastate" the U.S. textile
industry.

Richard Coles, president of Multitex, an apparel division of Sirius
Group, based in Port-au-Prince, Haiti, also would like to see more
T-shirts with Made in Haiti labels.

"The provisions within the bill will have a direct and immediate
impact on the woven part of the business and I think that we will get
7,000 to 10,000 immediate jobs," Coles said. He added that Hanesbrands
Inc. and Gildan are two of the largest foreign companies sourcing
apparel, primarily T-shirts, in Haiti.

According to Coles, 12 apparel companies have shut down in Haiti in
the past few years, leaving approximately 30 operating in the country.
Coles also has laid off workers. At its peak, Multitex employed 6,000
people and it currently employs 3,700, he said. But he acknowledged it
would be an uphill battle in Congress.

We write to you as representatives of workers from the CD Apparel factory in Por au Prince, Haiti at sonapi industrial park building # 31. As you know, on May 4, 2007, the Leaders of Hanesbrands ended their contract with CD Apparel S.A without sufficient warning throwing into jeopardy the livelihoods of over 500 workers and their families.The abusing cancellation and illegal closure of CD Apparel’s Plant by the responsibles of Hanes violates Haitian labor law which requires an employer to give workers twelves months for damages without forgetting twenty months that the workers are getting to demand from Hanes “ Compensation and repair” cause, after the brutal closure of CD Apparel on may 4, 2007 the workwers can not work and can not support their families in their socio-economic situation very very difficult.. The workers are also owed their severance pay and benefits for sixty six months remain unpaid from may 2007 to date. We request that Hanesbrand work with CD Apparel S.A to reach an agreement that will pay workers their severance and benefit pay include their compensation according to the code of conduct and the international legislation for work demanding Hanes’s responsibles to do it for any Plant in any country as they done it for D.R, PUERTO-RICO, CANADA, MEXICO AND U.S.A, once cancelled their Plant.Note that the CD Apparel’s workers: from May 4, 2007 to date are considered as current employees for Hanes via the contractor and owner of this Plant ,everyday they are standing to CD Apparel’s gate to demand their due.

For close to four years, over 500 workers produced T-shirts for Hanesbrands. During this period, we were commended for the high quality of our work and production levels. As a corporation whose Code of Conduct promotes workers rights, we are dismayed by your corporation’s lack of response to workers in Haiti and its violation of its own principles. Without our high quality work, Hanesbrands would not have remained as profitable as it did for 4 years.It’s for that CD Apparel’s Plant has been in the Caribbean the number one for Hanes about production and quality.

Given the very bad socio- economic reality of the Workers in Haiti after the devastating earthquake adding to several hurricane, the illegal closure of CD Apparel, the defiance of Haitian law and the violation of worker rights reflect a direct violation of your Code of Conduct and international labor rights. Salut à tous, par cette lettre révélatrice moi, César Medna qui suis le représentant principal des 500 ouvriers victimes de CD APPAREL S.A tiens à attirer l’attention de tous sur mes déclarations selon lesquelles Me Evel Fanfan demeure l’auteur principal du Sabotage des Matériels de CD APPAREL qui ont été scellés légalement par la Justice sous recommandation du comité exécutif avec approbation directe du PDG de cette entreprise, Mr Frantz Pilorge en date du mois de Mai 2007 pour mener la Bataille en Partenariat c’est à dire en parfaite relation de coexistence aux fins d’exiger :1) l’abandon des Matériels de Hanesbrands au profit des Victimes.2) Porter le Dossier de CD APPAREL, pour cause de Dédommagement et de réparations après la fermeture brutale et illégale de l’institution par les décideurs de HANES selon les prescrits de l’article 48 et 49 du code laboral Haïtien ainsi que les dispositions administratives et juridiques du Code of Conduct de Hanesbrands INC, par devant la chambre de commerce et d’arbitration de ICC à Miami Floride Brickell Avevue 1111 ce qui a été fait mais sans le comité Directeur, sans les 500 victimes parce que Me Fanfan a reçu clandestinement ou furtivement du Patron les Documents (Manifest) pour liquider ces marchandises qui étaient logés au parc industriel de la Sonapi vu sa position stratégique étant l’avocat des Victimes qui garde comme Juriste toutes les copies des scellés ainsi que son Homologue James Moise dont la personne qui a été commissionnée de lui transmettre ces données s’appelle Marc Guerrier suivant ce qui a été avoué ou dévoilé en son cabinet de Delmas 49 # 16 en date du 6 Septembre 2012 dans une réunion avec le comité directeur par James Moise aux environs de Midi et que je suis prêt et disposé de toute âme et conscience pure à en témoigner par devant n’importe quelle autorité toute la vérité sur la question suivant les documents légaux dont l’avocat lui même avait soumis au comité directeur prouvant clairement sa haute culpabilité dans l’affaire et si l’on trouve que Medna a manti ou a diffamé contre Me Evel Fanfan :Sans Mandat, sans plainte de personne je me disposerai à me rendre volontairement au Pénitencier nationale car se dit la Bible :La vérité n’a pas besoin de preuve puisqu’elle se definit,elle s’explique et elle s’affirme pour ainsi se faire apprécier de tous !!!

Hi all, by this revealing letter,me,César Medna am the chief representative of the 500 workers victims of CD APPAREL S.A want to draw the attention of all of my statements that Attorney Evel Fanfan remains the principal author of Sabotage of the Materials for CD APPAREL’s Workers who have been legally sealed by Justice on the recommendation of the Executive Committee with direct approval of the CEO ( PDG ) of the company, Mr. Frantz Pilorge the date of May 2007 to conduct the Battle rightly in Partnership that is in perfect relationship for coexistence to require:1) the abandonment of equipment for HANESBRANDS to the benefit of the Victims. 2) Submit the Case of CD APPAREL, because of Restitution and mending after the brutal and illegal closure of the institution by decision of the makers of HANES as prescribed in Article 48 and 49 of the Haitian labor code and the legal and administrative provisions of the Code of Conduct of Hanesbrands Inc., by ahead the chamber of commerce and arbitration of ICC from Avenue Brickell in Miami Florida in 1111 which was made without the Director Committee, without the 500 victims because Me. Fanfan Evel received secretly or furtively the documents (Manifest) to liquidate the goods (commodity) that were housed in the industrial park of Sonapi seeing that he has as attorney of the Victims all the copy of the seals and his counterpart name James Moise which the person was commissioned to transmit this data to Me. Fanfan is called Marc Guerrier following what has been confessed in his office at Delmas 49 # 16 dated September 6, 2012 in a meeting with the director committee by James Moise about Midday and I am ready and willing any soul and conscience pure to testify by any authority before the whole truth about the matter following legal documents which the lawyer himself had submitted to the Director committee clearly proving his high guilt in the Case or Matter and if we find that Medna lie, slander or libel against Me Evel Fanfan: Without Mandate, without complaint from anyone I dispose myself to go voluntarily to the National Penitentiary as a consistent citizen because the Bible says: The truth needs no proof since it defines, it is explained and it says so be appreciated by all!

As you know, on May 4, 2007, the Leaders of Hanesbrands ended their contract with CD Apparel S.A without sufficient warning or notice throwing into jeopardy the livelihoods of over 500 workers and their families adding the nasty heartquake destroyed our poor country.The abusing cancellation and illegal closure of CD Apparel’s Plant by the responsibles of Hanes with the complicity of the Haitian's employer violates Haitian labor law which requires an employer to give workers twelves months for damages and repairs without forgetting 45 months that the workers are standing on foot to demand from Hanes “ Compensation and repairs” cause by the brutal cancellation of CD Apparel on may 4, 2007 the workwers can not work and can not support their families in their socio-economic situation very very difficult.. The workers are also owed their severance pay and benefits for 45 months remain unpaid from may 2007 to date. We request that Hanesbrand work with CD Apparel S.A to reach an agreement that will pay these poor workers their severance and benefit pay include their compensation according to the code of conduct and the international legislation for work demanding Hanes’s responsibles to do it for any Plant in any country as they done it for D.R, PUERTO-RICO, CANADA, MEXICO AND U.S.A, once cancelled their Plant.Note that the CD Apparel’s workers: from May 4, 2007 to date are considered as current employees for Hanes and the contractor or owner of this Plant ,every day they are standing to CD Apparel’s gate to demand their due.

For close to five years, over 500 workers produced T-shirts for Hanesbrands. During this period, we were commended for the high quality of our work and production levels. As a corporation whose Code of Conduct promotes workers rights, we are dismayed by your corporation’s lack of response to workers in Haiti and its violation of its own principles. Without our high quality work, Hanesbrands would not have remained as profitable as it did for 5 years to their profit and theone of the CD APPAREL'S owner.It’s for that CD Apparel’s Plant has been in the Caribbean the number one for Hanes about production and quality.

Given the socio- economic reality of Haiti after, the Quake, the illegal closure of CD Apparel, the defiance of Haitian law and the violation of worker rights without forgetting the international social legislation on work reflect a direct violation of your Code of Conduct and international labor rights. We write to you as representatives of workers from the CD Apparel factory in Por au Prince, Haiti at sonapi industrial park building # 31. As you know, on May 4, 2007, the Leaders of Hanesbrands ended their contract with CD Apparel S.A without sufficient warning throwing into jeopardy the livelihoods of over 500 workers and their families.The abusing cancellation and illegal closure of CD Apparel’s Plant by the responsibles of Hanes violates Haitian labor law which requires an employer to give workers twelves months for damages without forgetting twenty months that the workers are getting to demand from Hanes “ Compensation and repair” cause, after the brutal closure of CD Apparel on may 4, 2007 the workwers can not work and can not support their families in their socio-economic situation very very difficult.. The workers are also owed their severance pay and benefits for twenty months remain unpaid from may 2007 to date. We request that Hanesbrand work with CD Apparel S.A to reach an agreement that will pay workers their severance and benefit pay include their compensation according to the code of conduct and the international legislation for work demanding Hanes’s responsibles to do it for any Plant in any country as they done it for D.R, PUERTO-RICO, CANADA, MEXICO AND U.S.A, once cancelled their Plant.Note that the CD Apparel’s workers: from May 4, 2007 to date are considered as current employees for Hanes and the contractor or owner of this Plant ,everyday they are standing to CD Apparel’s gate to demand their due.

For close to four years, over 500 workers produced T-shirts for Hanesbrands. During this period, we were commended for the high quality of our work and production levels. As a corporation whose Code of Conduct promotes workers rights, we are dismayed by your corporation’s lack of response to workers in Haiti and its violation of its own principles. Without our high quality work, Hanesbrands would not have remained as profitable as it did for 4 years.It’s for that CD Apparel’s Plant has been in the Caribbean the number one for Hanes about production and quality.

Given the socio- economic reality of Haiti, the illegal closure of CD Apparel, the defiance of Haitian law and the violation of worker rights reflect a direct violation of your Code of Conduct and international labor rights. We request a meeting with you to discuss the severance owed to CD Apparel’s workers and a resolution of the illegal closing.
We look forward to your response and an immediate resolution to this case

By the presente, we, the workers victims of the CD Apparel in Haiti want to attract the attention of the public opinion nationnal and international that the company Hanesbrands inc. (Hbi) is liveliness of itself in a manner disnonest defend when she declare that the work which is done in Haiti through internet by the workers is a companion of denigrement and of slander. By there, Hanes wants to hide the truth and destroy the light on the bad situation of the workers of the CD Apparel that itself caused for the decision to close in a manner brutal and illegal the CDApparel (HG) was taken by the persons in charge of Hanes May 4 2007 since this day more one than 500 workers are on the paved having Heavy responsibilities a lot money for bank and children to send to the school. They want to be damaged as all the others plants. We want sharply that the defenders of the human rights and the representants of the union organizations as well as the bosses of Hanes send their delegations in Haiti to CD Apparel s.a, Industrial Park (SONAPI) #31 in order to meet the workers for their information and to do the light on the question because carries it workers remained opened to all negotiation...

Speaking of Haiti he make understand that the Haitians workers are victims of racial discrimination. This enterprise “CD Apparel” has been congratulated by the same leaders for its efficiency and it’s products without any others .
The Haitians bosses put themselves to the bosses of Hanes side to exploit more the poor Haitian workers .

And Haitians workers suffer until now and the workers of this company are left to their own devices.
These workers can’t send their children to school , pay the rent not to say sanitary cares about fity thousand (50000) workers arrange themselves already for a strike which aims at two objectives:
1-Ask Hanes Brands to compensate the workers of CD Apparel
2-Ask the Haitian parliamentaries to note the law on minimum wage.
We, workers of the cd apparel let us learn that some bosses of the company Hanes Brands such as: Richard Noll, Gerard Evens, Jorge Oliva from WRAP and others ally themselves with the haitians employers to know: the Bakers, the Apaids, and Richard Coles to prevent to the employees of CD Apparel to obtain their damages and repairs as Hanes does it always for the others plants.For your information, we say that :
Haitian government for the coming days will arrest certain other bosses for corruption and contreband , after the brandt , the Boulos , it will be the Baker’s and Richard Coles, the Apaid’s , Madsen, Acra, Meuz turn . This is the reason we want to ask the persons in charge of hanes to divorce with these employers in order not to to be considered as accomplice in the file of the workers of cd apparel because the state haitian [René Preval] will follow: authors and accomplices in this so national one as international file if hanes refuses, she will be considered as social danger for all the workers of the entire world.
We are waiting fo Hanes investigation in Haiti to release this crisis.
